Due to the Tigers already auto-drafting two Shortstops this year, the committee has decided to skip the next available player and take the one after.
The Detroit Tigers draft Marco Gonzales, LHP, Gonzaga.

The Pirates select SS Jordy Mercer out of their own organization.
And just in case there's any concern about his eligibility- I'm told Connor has an ear implant start vibrating any time one takes place- the following section from the free agent rules page shows that he qualifies:
Once a player becomes free agent eligible, they lose their draft eligibility. For example, if a 26 year old player has one previous year of MLB experience and then starts the following season in the majors, he will still be draft eligible during that summer, because he has not yet become free agent eligible. But once the season ends, the player is no longer draft eligible but is now free agent eligible.

Time Out. Rule Check A player will be considered to be free agent eligible if he meets the following criteria:
-Has reached 26 years of age (all birthdays are considered January 1 in the NSBL to eliminate any confusion), and either -Has played in all or parts of five different previous minor league seasons, in separate calender years (Independent Leagues do count towards minor league seasons), or -Has played in all or parts of two different previous Major League seasons. Mercer had 5 minor league season and reached 26 before this season 2008-12, 1986. By my understanding - he is not eligible due to his minor league experience.

Disagree, as I stated to you via e-mail. Mercer's exact scenario is exemplified in the free agent language that I quoted in my post.
Had I tried to draft Mercer next season, I absolutely agree that he would be ineligible. But as the rules are currently written, there are no contradictions.
Please don't punish me for having language that you feel is ambiguous. If you feel changes are needed, please do after the draft, as opposed to changing them partway through.

PS I think the hangup- which I actually e-mailed Joe about prior to my pick- is this:
As written, the language is NOT mutually exclusive. I think a player like Mercer COULD be signed as a free agent this year, AND be drafted. Part of the reason I've been going antsy over the past 2 days is because, with him doing well, I was worried someone was going to sign him to a 1-year V 0.800 contract out from under me.
You guys do a phenomenal job with the rules for the league, but I think this is one of the few areas where there's some overlap, intentional or not.

I think there should have been two examples but the key in the rules I think is the "for example" part. There are two ways a guy becomes ineligible for the draft. Age 26 + 2 years in majors before new season or Age 26 = 5 years in minors before new season I agree that he fits the "example" but the example was only explaining one of the two ways the guys become FA's. I'm no longer on the committee so take the above for what it is, just my opinion after reading the rules. Tracy The Pirates select SS Jordy Mercer out of their own organization. That's not true. The example specifically points out that he still IS draft eligible for the entire season.

My belief is that Mercer is draft eligible this summer draft and winter draft, and then becomes FA eligible next Winter (2014 FA Season).
He's currently unable to be signed as an in-season 1/0.800 FA since he only had 4 milb seasons/1 mlb season prior to the start of this year, so it is most definitely a legal pick.
